Terms & Conditions
Delivery:
The buyer shall inspect the goods on delivery and notify 4x4x4 immediately if the goods are damaged or do not comply with the contract.
The buyer should refuse to accept delivery of goods if there is clear evidence that the goods have been damaged in transit.
Delivery Dates:
Whilst every reasonable effort shall be made to keep to any delivery date, time of delivery shall not be of the essence. 4x4x4 shall not be held liable for any losses, costs, damages or expenses incurred by the buyer or any other person or company arising directly or indirectly out of any failure to meet any estimated delivery date.
Unless otherwise agreed, we may deliver purchases of multiple items in installments and in such case each installment shall be treated as a separate contract.
Safe Place:
If the buyer redirects the delivery of their goods to an alternative location e.g. a safe place or neighbour, it is done so at the buyers’ risk. 4x4x4 cannot be held liable if goods are lost or found damaged when delivered to an alternative location at the buyers request.
Returns:
(a) The buyer must notify 4x4x4 in writing within 14 calendar days from the day the goods were received by the buyer.
(b) Return instructions provided by 4x4x4 must be adhered to by the buyer.
(c) The returns number must be clearly shown on the outside of all returned parcels.
(d) 4x4x4 may request the goods are returned to 4x4x4 or its agent.
(e) Goods cannot be returned without the prior approval of 4x4x4.
(f) The goods remain at the buyer’s risk in all respects until checked and approved by 4x4x4 or its agent.
(g) If requested by 4x4x4, the buyer agrees to provide information including images relating to the product, prior to returning any goods.
(h) The goods must be received by 4x4x4 or its agent within 14 calendar days from the day the buyer first notified 4x4x4 of their intention to return the goods.
(i) Goods must be returned in their original brand new condition, complete with all fixings, instructions and paperwork.
(j) Goods cannot be returned if they have been used or fitted.
(k) Goods cannot be partially returned, goods ordered as a set, must be returned as a set.
(l) Goods can only be returned by the buyer that purchased the goods from 4x4x4.
(m) The buyer will be responsible for the cost of returning goods, unless we are at fault.
(n) 4x4x4 reserves the right to reject any claim for a refund in whole or in part if the goods have been used, fitted, worn, damaged, marked, stained, tampered with or are incomplete.
(o) 4x4x4 reserves the right to refuse to accept any returned goods that have been damaged in transit during the return journey.
(p) The buyer will be liable for the cost of remedying any damage to goods returned where such damage has, in the opinion of 4x4x4, been caused by the goods being inadequately packed by the buyer or through the buyer’s fault.
(q) 4x4x4 cannot be held liable for any goods that are lost in transit or returned to the incorrect address.
(r) Where the buyer is dealing as a trade customer, 4x4x4 reserves the right to make a handling and restocking charge of 25% on goods which are returned if they were ordered in error or are no longer required.
(s) Unwanted goods cannot be returned after the return periods specified above.
Faulty Goods :
(a) Any goods in respect of which any claim is made shall be preserved by the buyer intact and at the buyers risk.
(b) The buyer agrees to provide the seller with full details of the fault including images.
(c) At the sellers option, goods shall be returned by the buyer to the seller or its agent.
(d) Damaged goods cannot be returned unless the damage was caused by a fault.
(e) The seller or its agent will inspect the goods for faults reported by the buyer within 14 days of receiving the goods.
(f) The cost of postage will be returned to the buyer if the goods are in fact faulty.
(g) If the seller or its agent finds the goods are not faulty, no refund, repair or replacement will be offered and the buyer will be responsible for recovering the goods from the seller or its agent’s premises.
Product Suitability :
All products made available for sale through this website are for vehicles supplied for the UK market.
We do not supply goods for imported vehicles or vehicles not originally supplied for the UK.
Fitting :
All accessories must be fitted in strict accordance with the manufacturers fitting instructions.
4x4x4 shall not be held liable for any damage or injury caused by incorrect fitment.
4x4x4 shall not be held liable for fitting related costs or for goods not fitting due to any of the following reasons:
(a) Customer not declaring their vehicle has other accessories or equipment fitted, alterations or modifications that may affect fitment of our accessories.
(b) Vehicle does not have UK specification i.e. imported vehicle.
(c) Buyer has purchased incorrect item or provided incorrect details of vehicle and/or model.
(d) Vehicle has accident damage that affects the fitment of our accessories.
Product Colours:
Whilst we have made every effort to display the images and colours of our products as accurately as possible on this website, we cannot guarantee the accuracy of any colour displayed on your device.
Payment
UK Customers – payment can be made via debit or credit card, bank cheque, draft or transfer.
Customers outside the UK – payment can only be made via bank transfer and must be paid in British Pounds Sterling and settled in full prior to any goods being despatched. Full details are available upon request.
Card Payments
All credit and debit cards used on this site must be registered to an address in the United Kingdom.
Payments made using a credit or debit card not registered in the UK will be refunded minus any card transaction fees incurred.
The delivery address must be the same as the card address, unless it’s a registered business address.
Prices:
All prices on this website are in British Pounds Sterling.
All prices include VAT @ 20%.
Prices for our products are subject to change without notice.
Liability:
Except as may be implied by law where the buyer is dealing as a consumer, in the event of any breach of these conditions by the seller, the remedies of the buyer shall be limited to damages which shall in any circumstances not exceed the price of the goods and the seller shall under no circumstances be liable for any indirect, incidental or consequential damages.
Dispute:
In the event of dispute between the buyer and the seller, should the seller request in writing, the buyer agrees to submit the dispute to arbitration in accordance with the arbitration action for the time being in force as a legally binding alternative to court action.
Nothing in these conditions shall affect the statutory rights of any consumer.
These conditions shall be construed in accordance with English Law.
